FIGA LLC Terms and Conditions
Effective date: October 12, 2026
1. Acceptance and Scope
These Terms and Conditions ("Terms") govern use of FIGA LLC's ("FIGA," "we," "us," or "our") public website, publicly offered registration functions, contact features, and related informational services.
Please review these Terms and our Privacy Policy before submitting information or using the website.
Where a form requires express acceptance, the user must take the indicated affirmative action.
These Terms do not replace a separate written provider agreement, a valid employment contract between a caregiver and a hiring provider, or obligations imposed by applicable law.
If a separate signed agreement governs a particular paid service, its enforceable provisions govern that service to the extent legally permitted.
2. FIGA's Services
FIGA is an Oregon-based caregiver referral and staffing coordination company.
FIGA assists interested caregivers and hiring providers by gathering relevant professional information, coordinating communication, considering potential referrals, and documenting related follow-up.
Under FIGA's current referral model, caregivers are hired and paid by the hiring provider, not automatically employed by FIGA merely because they register or receive a referral.
A registration, inquiry, professional introduction, or referral does not create an employment relationship with FIGA or guarantee an employment relationship with a provider.
FIGA does not provide medical diagnosis, treatment, emergency response, or patient care advice through the general public website.
Nothing in these Terms excludes responsibilities that FIGA itself may have under applicable law.
3. No Guaranteed Employment or Placement
Submitting an application does not guarantee a job, interview, referral, offer, salary, schedule, or other employment outcome.
Hiring providers independently evaluate and select applicants, subject to applicable law.
FIGA does not guarantee that every provider request can be fulfilled or that every candidate will accept an opportunity.
FIGA may contact applicants about potential opportunities, but no particular volume or frequency of referrals is promised.
Any specific and lawful service guarantee agreed in a separate written provider agreement is governed by that agreement.
4. Caregiver Registration and Information Accuracy
People registering with FIGA must provide information that is accurate to the best of their knowledge.
Applicants should update FIGA when material details change, including contact information, availability, qualifications, and interest in future opportunities.
Do not impersonate another person or submit information on someone else's behalf without proper authority.
Do not invent or falsify certifications, qualifications, work history, references, or professional experience.
Applicants may request corrections to their own records through FIGA's official contact process.
Registration does not require applicants to accept a particular referral or job offer.
Do not submit Social Security numbers, bank credentials, unrelated identity documentation, patient records, medical diagnoses, or other unnecessary sensitive materials through general public application channels.
5. Referral Decisions and Professional Screening
FIGA may consider relevant job requirements, stated qualifications, work preferences, availability, and provider needs when evaluating potential referrals.
Professional profiles and qualification descriptions may be based partly on information supplied by applicants, providers, or other sources.
FIGA does not represent that every credential, certification, reference, background report, license, driving record, or professional statement has been independently verified unless FIGA specifically confirms that a verification step was completed.
Hiring providers are responsible for the employment decisions, screening steps, and lawful employment processes assigned to them under applicable law and their agreements.
Where FIGA independently undertakes a regulated screening or referral activity, it remains responsible for its own applicable duties.
FIGA does not agree to unlawful discrimination in referral decisions.
6. Provider Inquiries and Responsibilities
Providers currently contact FIGA through its authorized business communication channels to describe legitimate staffing needs.
Provider representatives must have appropriate authority to submit requests for their organizations.
Providers must supply reasonably accurate information about requested duties, qualifications, schedules, work locations, and employment opportunities.
FIGA may verify the legitimacy of a provider, contact person, and staffing request before making a professional introduction.
Providers must not request discriminatory exclusions or preferences contrary to applicable law.
Providers are responsible for complying with applicable hiring and employment requirements, including wages, employment eligibility verification, workplace conditions, required screening, supervision, accommodations, and insurance duties where applicable.
These Terms do not relieve FIGA or providers of their independent legal obligations.
Providers are not granted unrestricted access to FIGA's private caregiver records merely by contacting FIGA or using the website.
7. Referral Information and Confidentiality
FIGA may share limited professional information with a verified provider for a legitimate staffing opportunity, consistent with its Privacy Policy and applicable permission procedures.
Private caregiver contact information is handled separately and should be shared only through the appropriate authorized referral process.
Providers receiving caregiver information must use it for lawful professional evaluation and protect it from unauthorized disclosure, redistribution, marketing, or unrelated purposes.
A caregiver's general website registration does not grant permission for unrestricted circulation of private contact details.
8. Provider Fees and Separate Agreements
Viewing the FIGA website or submitting a general inquiry does not itself create a service fee, subscription charge, employment fee, or other payment obligation.
Any applicable commercial referral fee must be established through an appropriate separate written agreement and lawful business arrangement.
Applicable fees, refunds, replacement arrangements, service commitments, and payment terms are governed by that agreement rather than implied by this public website.
FIGA will not use these public Terms to impose an undisclosed fee on a caregiver.
9. Contact Permission and Optional SMS Program
Providing contact details allows FIGA to respond to appropriate inquiries and conduct legitimate communications, subject to applicable law and stated preferences.
Providing a telephone number or submitting an application does not automatically constitute consent to recurring automated SMS or unrelated marketing messages.
If FIGA activates its optional caregiver SMS program, participation will require a separate, appropriate affirmative opt-in.
The intended program is FIGA Caregiver Opportunity and Availability Updates, which may provide messages about possible caregiving opportunities, interest or availability confirmation, and related referral follow-up.
For an active optional SMS program:
- Enrollment is voluntary.
- Consent is not required merely to register or be considered for referrals.
- Message frequency may vary.
- Message and data rates may apply.
- Participants may reply STOP to opt out.
- Participants may reply HELP for assistance.
- FIGA's verified support contact methods must be available.
- Delivery cannot be guaranteed because carrier, device, or network restrictions may apply.
SMS consent and opt-out information is handled as described in FIGA's Privacy Policy.
FIGA does not sell or share mobile opt-in information with unrelated third parties or affiliates for independent marketing or promotional purposes.
Authorized messaging vendors may process information as necessary to deliver FIGA communications and manage consent or suppression.
Permission to share a caregiver telephone number with a particular hiring provider for an approved referral does not authorize that provider to send FIGA-related marketing texts.
These provisions do not mean that an SMS program is currently active. No recurring messaging program begins until the required consent, support, opt-out, technical, and registration processes are operational.
10. Acceptable Website Use
Users must not:
- Impersonate another person or organization.
- Submit fraudulent applications, references, credentials, or staffing requests.
- Attempt unauthorized access to caregiver information, accounts, staff tools, or databases.
- Scrape, harvest, download, redistribute, or sell private applicant information without authorization.
- Bypass security controls or interfere with website operation.
- Submit malicious software or attempt to exploit system vulnerabilities.
- Use information obtained through FIGA to harass, threaten, discriminate against, deceive, or improperly contact another person.
- Upload patient records, confidential records belonging to others, or unlawful content without authorization.
FIGA may respond appropriately to misuse, including investigating incidents or restricting access where lawful.
11. Website Content and Intellectual Property
The original text, designs, logos, trademarks, and other protected content on the FIGA website are owned by FIGA or their respective rights holders.
Users may access public website information for normal personal or professional purposes.
They must not reproduce or use protected material in a manner that falsely implies FIGA's authorization, endorsement, or affiliation.
Information submitted by applicants or providers remains subject to their applicable rights.
Submission permits FIGA to use the information as reasonably necessary to deliver the requested lawful service, subject to the Privacy Policy, these Terms, and applicable law.
12. External Platforms and Links
The website may refer users to external services or communications platforms, including independently operated provider websites or messaging services.
External services may have their own terms, privacy policies, and security practices.
FIGA does not automatically endorse or guarantee the accuracy, licensing, safety, or professional competence of every outside party merely because it provides a link or facilitates a professional introduction.
13. Availability and Information Accuracy
FIGA seeks to provide useful and accurate public information but does not guarantee uninterrupted website access or error-free content.
Staffing needs, applicant availability, and professional circumstances can change.
Users should confirm essential job terms directly with the hiring provider before accepting employment.
Website functions may occasionally be interrupted because of maintenance, network issues, security needs, or service-provider failures.
The public website is not an emergency response or time-critical medical service.
14. Disclaimers and Limits of Liability
To the extent permitted by applicable law, public informational website services are provided on an as-available basis.
FIGA does not guarantee employment results, uninterrupted website access, or the accuracy of every self-reported applicant or third-party statement.
Any lawful limitation of liability applies only to the extent permitted by relevant law and controlling agreements.
Nothing in these Terms excludes responsibility for fraud, unlawful discrimination, intentional misconduct, or other liability that applicable law does not permit to be waived.
Specific commercial risk allocations for paid provider services should appear in separate written agreements where appropriate and lawful.
15. Questions, Complaints, and Disputes
If a user has concerns about the FIGA website, a professional referral, incorrect records, privacy, or communications, they may contact FIGA using its official contact details.
FIGA may attempt to resolve disputes informally where appropriate.
However, informal discussions do not prevent individuals from reporting unlawful activity, contacting regulators, or exercising rights that cannot legally be waived.
Subject to applicable law and any controlling agreement, these Terms are interpreted under Oregon law, without overriding mandatory protections that may apply in another jurisdiction.
These Terms do not impose mandatory arbitration or a class-action waiver.
16. Changes to the Terms
FIGA may revise these Terms to reflect changes in the website, services, business processes, or applicable requirements.
Updated Terms will be published with an effective date.
Where additional notice, renewed agreement, or other steps are required by applicable law or an enforceable contract, FIGA will follow those requirements.
Changes do not retroactively remove legal rights in a manner that applicable law prohibits.
If a provision is found unenforceable, the remaining Terms will continue to apply to the extent legally possible.
